While that is true, Im not positive but it would kind of be moot at the time he said that. Without the cops being there to see him consume it and not being drunk at the time of talking to them, I dont think they would have standing. Its like getting a ticket after you see a cop at a stop light and roll down your window and tell him you were speeding 3 hours ago.
