You may be committing libel with your post heading.
I'm sure your'e saying that because you care and you're not trying to stir it up?  Stop it with that nonsense.

I don't know about the US law on defamation but in the UK the OP could have a problem. And yes it was to help and not stir things up. I'm not sure if there is some tongue in cheek element in your post?
I'd simply change to 'Problems with' would resolve the issue.

also, if you feel their business practices are ethical, please give me the names of the business you own and i will be sure to avoid them in the future.

Hey, don't take your frustration out on me.

I'm not the one that made the mistake of not reading the T&C of the site when typing my credit card info in.

These are your words, not mine:

Quote

I noticed on 10/07/16 the charge on my CC bill, and decide that I don't want another year on the site, so i contact site support for a refund.  not only do i get denied due to some cockamamie terms and conditions bullcrap

It took me all of (45) seconds to find the "Initial Term" and "Cancellation" policy on the site.

Let's be clear, this is your mistake, not this website's mistake.

jj9000, are you in cahoots with Ronnie from GG's site?  you guys sound very similar.

here are the terms that i signed up for that were outlined in my order confirmation email:

Quote

Terms
$197.00 now, then $197.00 yearly. Cancel anytime.

Product URL
http://members.ggswingtips.com

obviously, the terms and conditions when i first signed up to now have changed drastically.  i was never informed of the update.  i went to the site to get good golf information, not to see if there were updates in their T&C.  the site is trying to hold me to T&C that I never agreed to.

I'm not in cahoots with anyone, nor am I affiliated with the site.

The Terms and Conditions that you admittedly signed up for (within the URL you just posted) are explicit:

Cancellation Policy

GGswingtipsgolf Memberships
Monthly/Annual membership fees are non-refundable and are charged automatically on each renewal date (i.e. monthly or annually) until you cancel. You may cancel at any time during the month or any point through out the year. Upon cancellation, your Membership will expire 30 days from the last payment. Any amounts paid prior to your cancellation are not refundable. To cancel your Membership, sign into your account on the site. To cancel, you may also send an email to ggswingtips@gmail.com.

Auto Renewal is all about making cash not customer service, that is fact.  With that said be persistent with GG as i'm sure he's busy and usually the squeaky wheel gets the grease.  He's a pretty stand up guy so give him the benefit of the doubt for a minute.

if you're a large multi million dollar business you probably can afford to stick to the fine print and not make exceptions.

If you're a small start up business looking to grow its customer base and keep them happy while gaining a good reputation for client service....maybe you go on a case by case basis and refund the OPs money or at a minimum pro rate the few days he was a member after the renewal rate and refund the remainder.

As a general comment if a site like this takes Paypal, you can turn off the auto-renewal from your Paypal account.

At any stage of business you just refund.  It's not worth the bad blood.  Of course my company sends out invoices for our auto bill clients 30 days before renewal for annual subscriptions to my service, and my terms and conditions are similar.   Even when I was just starting out I didn't need the money bad enough to piss off clients.

I had a similar instance.  It was with the original people who ran the first site or platform and George had moved on to another completely different site.  I reached out to George and he comped me membership to his new site.  He was professional about it an obviously cares about his customers. It is one thing to forget about auto renewal another to get that auto renewal from a site that was no longer getting new info from George.  I dunno if this fish and Gabe people were involved with the new site but they are the scammers from the first site.

the whole thing was awkward and odd.  Suddenly a new site and no warning etc.

Exactly, that the one thing that is missing, everything changed mid-year.  When I reached out I was promised a bunch of stuff that never happened so I guess I didn't whine enough.   I just wrote it off figuring GG needed the money more than me.

jj9000, thanks for that bc you just proved my point.  i originally signed up for ggswingtips.com in 10/2016. in 2017, he revamped his site and came out with ggswingtipsgolf.com, members from the old site just got ported over to the new one and apparently with a brand new T&C.  Any T&C updates legally have to be given to customers, which I was not.

to make things even more confusing, the actual charge is from the original site: ggswingtips.com, not his new site: ggswingtipsgolf.com

another weird thing was my account showed cancelled and no 2nd charge but they charged me again the next year in april 2017.  So you can see it says last charged 2016 but they charged me again april 2017 and I just happened to catch it on my cc bill.  that is when I contacted George directly.  I don't recall if I knew he even had a new site.

OP, here's my advice:

First change the title of this thread since this is largely your fault for not really knowing the true Terms and Conditions for what you signed up for.

Next send a letter to the company return receipt requested that states that you are hereby terminating your membership effective at the next renewal date on 10/05/2018. Further you are placing them on notice that there is no further authorization for any charges on your bank account and in the event monies are taken from any of your bank accounts you will immediately seek fiscal remedy up to and including the monies they removed plus any charges that may result from having to obtain a refund.

Next, contact your CC company and tell them you need a new card number that your account may have been breached.

Finally enjoy your membership. The TOS are pretty clear and you failed to cancel before they took the money out. If I were you I'd be using the hell outta that sight. Like 24-7. I'd burn up so much of their BW they'd realize I was the one member they were actually losing money on. : )

Not what you wanted to hear. But solid advice none the less. Perhaps some of the attorneys on here can verify I am 'on the money' here. (I did this under similar circumstances awhile back and never got charged another dime. Did not get a refund but didn't get charged again either.)

You still haven't read the T&C of the site you signed up for.

The URL you posted above = (http://members.ggswingtips.com)

ggswingtips.com is the site.

1. Click the URL
2. Click Disclaimer
3. Scroll to the bottom of the Disclaimer link and read the massive bolded portion at the bottom

No.

I also don't blatantly trash a Website and business, and drag their name(s) through the mud because of my own errors.

Take a close look at the title of this thread, which you created.

There's nothing shady about your situation.

You failed to read the site's T&C, and created a thread that has the potential to hurt this business.

Meanwhile, the root cause of the error is your initial oversight.

never realized they had a site, always saw the videos on IG. could easily use those as "swing tips"? on the topic I've set some reminders on my iPhone to remind me to cancel any subscription I've paid or have gotten free but they always want your CC info. i'll cancel about a week before.

straight from Google:
shady - of doubtful honesty or legality.
synonyms: suspicious, suspect, questionable, dubious, doubtful, disreputable, untrustworthy, dishonest, devious, dishonorable, underhanded, unscrupulous, irregular, unethical
antonyms: reputable, honest

im not about ruining good businesses, i am very appreciative of high quality/high integrity companies that stand by their product and care for the satisfaction of their customers.  i found the way his site handles the auto-renewals for year long subs unethical in my view.  give your customers no renewal notice whatsoever and just charge them for another full year with no recourse even a day after the fact.  legal, perhaps.  questionable, absolutely.

i love GG's videos let me be clear on that, i just wish his site operators would match the level of quality of his content.

it actually depends.  if you signed up at his original site, ggswingtips.com, you may need to go there to cancel your sub instead of ggswingtipsgolf.com

when i looked at my settings under the new site ggswingtipsgolf.com, i also did not find an option to cancel my sub.  but when i logged back into the old site, i found those options there, but unclear if they even work.

Man, this thread is a trainwreck.

I really can't get too passionate about getting on the OP's side here with the oversights on his part, but I just can't bring myself to defend one of these "auto renew" companies. They're just scummy. Which is why I also can't get behind trying to tell the OP to change the title. It sounds like it's accurate.

I really can't get too passionate about getting on the OP's side here with the oversights on his part, but I just can't bring myself to defend one of these "auto renew" companies. They're just scummy. Which is why I also can't get behind trying to tell the OP to change the title. It sounds like it's accurate.

Really? Most gym memberships have the same auto-renew policy.  I don't care for the policy myself, but this is pretty common now days.

Apple, Google, Netflix etc all use auto renew.  In fact I would go so far as to say that in the digital age auto-renew is the standard for subscription services.

jj9000, is that the first section you hit up when you go to a website? lol, you have some humorous posts, sir.

As someone in customer service, I totally agree with you. But... a customer in the "me first" world we live in will not be slowed down by saying they willingly agreed to your terms. If they feel wronged, your only option is to work with them and try to make right. Otherwise it's a recipe of intense social media blasting, which is not worth it.

Sometimes you have to do the right thing, even if it is  against all of your terms, policies, and regulations. My take is if you handle these things in a friendly and professional manner, you might eventually get that customer back. If you don't, then you lose them forever, plus some people they know, and a bunch of negative social media comments.

It's rarely worth it to say, "read the policy" and then hang up the phone.

As I read the original post, the complaint is not that he was auto-charged. It was that he got stuck with a year that he didn't want and could not get out of (which, I believe, was the real surprise to the OP).

I don't know if I would call this shady, but this is at the least poor business practice that deserves criticism in some form.

And when you join a gym you join knowing this up front and know you can cancel at anytime. As for the Apple, Netflix, and google reference....again they don’t try to bury the auto renewal in small print and with Apple you can just turn it off and you renew manually. It’s a shady business practice to say the least to try and stick someone especially when it’s a yearly renewal. File a complaint with the BBB and you will get a refund.
